These Terms and Conditions ("Terms") govern your access to and use of the Exhibit: Daily Fit Check mobile application ("App"), operated by Afan Rashid doing business as Exhibit ("Exhibit," "we," "us," or "our"). By downloading, installing, creating an account, or otherwise using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

1. Eligibility

You must be at least 13 years old to create an account and use the App. If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf and consents to your use of the App. We do not knowingly collect personal information from children under 13. If we discover that a user is under 13, we will promptly deactivate the account and delete all associated data.

2. Account Registration & Security

To use the App, you must create an account using one of the following methods:

• Phone number authentication: You will verify your identity via an SMS code sent to your mobile device.
• Apple Sign In: You may register or log in using your Apple ID.

You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the confidentiality and security of your account credentials.
• Accept responsibility for all activity that occurs under your account.
• Not create accounts for others, impersonate another person, or use a misleading or deceptive username.
• Not create multiple accounts for the same person.
• Notify us immediately if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate any account that violates these Terms or that we reasonably believe to be fraudulent.

3. User Content

Ownership

You retain full ownership of the photos, captions, tags, comments, and other content ("User Content") you create and post on the App.

License Grant

By posting User Content, you grant Exhibit a non-exclusive, royalty-free, worldwide, transferable, sublicensable license to use, host, store, display, reproduce, modify (for formatting and technical purposes only), and distribute your User Content solely for the purposes of operating, providing, improving, and promoting the App. This license continues until your User Content is deleted from our systems, either by you or upon account deletion.

Your Representations

By posting User Content, you represent and warrant that:

• You own the content or have all necessary rights and permissions to post it.
• Your content does not infringe, misappropriate, or violate any third party's intellectual property, privacy, or other rights.
• Your content complies with these Terms and all applicable laws.

4. Content Guidelines

Exhibit is a fashion and outfit-sharing community. You agree not to post content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene.
• Contains nudity, sexually explicit material, or graphic violence.
• Promotes violence, discrimination, hatred, or harassment against any individual or group.
• Is designed to bully, intimidate, or demean other users.
• Infringes on the intellectual property rights of others.
• Contains spam, unauthorized advertising, solicitations, or promotional material.
• Includes malware, viruses, or any harmful or malicious code.
• Misrepresents your identity, affiliation, or the origin of the content.
• Contains personal or confidential information of another person without their consent.
• Encourages or facilitates any illegal activity.

We reserve the right to remove any content that violates these guidelines at our sole discretion, with or without notice, and to suspend or permanently terminate the accounts of repeat offenders.

5. The One-Active-Fit Rule

Exhibit operates on a "one active fit" model, which is a core feature of the App:

• Each user may have only one active (publicly visible) outfit post at any time.
• When you post a new outfit, your previous active post is automatically archived from public feeds.
• Active posts expire after 24 hours and are automatically archived.
• Archived posts remain accessible only to you in your private archive.
• This behavior is intentional by design and cannot be overridden.

6. Feeds & Content Discovery

The App provides three content feeds for discovering outfits:

• Friends Feed: Shows active posts from users you follow who also follow you back (mutual friends).
• Exhibit (For You) Feed: A personalized feed that ranks and surfaces content based on your engagement patterns, including your voting history, viewing behavior, and content preferences. This personalization is powered by a taste profile that is automatically generated and updated as you use the App.
• Nearby Feed: Shows active posts from users in your geographic area (approximately 25-mile radius), based on your device's location data.

When posting, you can choose which feeds your outfit appears in (Friends, Exhibit, Nearby, or any combination). Feed algorithms and ranking may change at any time without notice as we improve the App.

7. Social Interactions

The App enables the following social features:

• Following: You may follow other users. When two users follow each other, they become mutual friends.
• Voting: You may upvote or downvote posts. Votes influence content ranking in the Exhibit feed and contribute to a poster's upvote count displayed on their profile.
• Comments: You may post comments on other users' active posts. Comments must comply with our Content Guidelines. We reserve the right to remove comments that violate these Terms.
• Posting Streak: The App tracks consecutive days on which you post an outfit. Streaks are displayed on your profile and reset if you miss a day.

8. Messaging

The App provides direct messaging, including:

• One-on-one chats: Private conversations between two users.
• Group chats: Conversations involving multiple users.
• Media sharing: You may share images and GIFs within messages.

All messages are subject to our Content Guidelines. You agree not to use messaging to harass, spam, or send unsolicited content to other users. We do not actively monitor private messages, but we may review reported messages to enforce these Terms.

9. Location Services & Passport

Certain features of the App require access to your device's location:

• Nearby Feed: Uses your device's GPS to show posts from users in your geographic area. Location data is encoded as a geohash for privacy and queried at reduced precision (approximately city-level).
• Passport: Allows you to virtually set your location to browse the Nearby feed in other areas. Passport locations are stored locally on your device and are reduced to approximately 1.1 km precision.
• Post Location: If you post to the Nearby feed, your post's approximate location is stored to enable geographic discovery.

You may disable location permissions at any time in your device settings, but the Nearby feed and related features will not function without location access. For more information on how we handle location data, please refer to our Privacy Policy.

10. Music Integration

The App integrates with Spotify to allow you to attach music to your outfit posts:

• You may search for and attach songs to your posts, which will display the track name, artist, and album artwork.
• Music previews (up to 30 seconds) may be played by other users viewing your post.
• This integration uses the Spotify Web API and does not require you to have a Spotify account.
• Music content is provided by Spotify and is subject to Spotify's Terms of Use. We do not own or control the music content available through this integration.

11. GIF Integration

The App integrates with GIPHY to allow you to send GIFs in messages:

• GIF content is provided by GIPHY and is subject to GIPHY's Terms of Service.
• We do not own, host, or control the GIF content available through this integration.

12. Outfit Search & Detection

The App may offer features that use computer vision technology to:

• Detect clothing items in your outfit photos.
• Search for similar clothing items or outfits.

These features use Google Cloud AI services. By using outfit search and detection, you consent to your outfit photos being processed by these services for the purpose of identifying and matching clothing items. No facial recognition is performed. These features may not be available at all times and their accuracy is not guaranteed.

13. Push Notifications

The App may send you push notifications about activity related to your account, including new followers, votes, comments, messages, and other interactions. You can manage or disable push notifications at any time through your device settings or the in-app notification preferences.

14. Content Moderation

We use automated content moderation systems, including Google Cloud Vision SafeSearch, to detect and flag content that may violate our Content Guidelines, such as nudity or explicit material. Content flagged by our moderation systems may be:

• Automatically removed or hidden from public feeds.
• Manually reviewed by our team.
• Result in account suspension or termination for repeat violations.

Automated moderation is not perfect and may occasionally flag content incorrectly. If you believe your content was wrongly removed, you may contact us at ops@joinexhibit.com to request a review.

15. Blocking & Reporting

You may block other users at any time. When you block a user:

• They will no longer be able to see your posts, profile, or send you messages.
• Their content will be hidden from your feeds.
• Any existing follow relationships between you will be removed.

You may unblock a user at any time from your settings. If you encounter content or behavior that violates these Terms, we encourage you to report it to us at ops@joinexhibit.com.

16. Acceptable Use

You agree not to:

• Use the App for any unlawful or unauthorized purpose.
• Attempt to gain unauthorized access to other accounts, systems, networks, or data.
• Interfere with, disrupt, or place an unreasonable burden on the App or its servers and infrastructure.
• Use bots, scrapers, crawlers, or other automated tools to access, collect data from, or interact with the App.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
• Harass, bully, stalk, intimidate, or threaten other users.
• Circumvent, disable, or interfere with any content moderation, safety, or security features of the App.
• Use the App to distribute unsolicited commercial messages (spam).
• Artificially manipulate votes, engagement metrics, or feed rankings.
• Create fake accounts, impersonate others, or misrepresent your affiliation with any person or entity.
• Use the App in any way that could damage, overburden, or impair the functioning of the App.

17. Intellectual Property

The App, including its design, user interface, features, functionality, code, graphics, logos, and branding (excluding User Content), is the exclusive property of Exhibit and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works based on the App or any of its components without our prior written permission.

The Exhibit name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Exhibit. You may not use these marks without our prior written permission.

18. Copyright Complaints

We respect the intellectual property rights of others. If you believe that User Content on the App infringes your copyright, please send a notice to ops@joinexhibit.com with the following information:

• A description of the copyrighted work you claim has been infringed.
• A description of where the allegedly infringing material is located on the App (e.g., a username or link).
• Your contact information (name, address, phone number, and email).
• A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
• Your physical or electronic signature.

We may remove or disable access to content that is alleged to be infringing and may terminate the accounts of repeat infringers at our sole discretion.

19. Third-Party Services

The App integrates with the following third-party services:

• Firebase (Google): Authentication, data storage, cloud functions, file storage, analytics, and push notifications.
• Spotify: Music search and 30-second preview playback.
• GIPHY: GIF search and display in messages.
• Google Cloud AI: Content moderation (SafeSearch) and outfit detection/search.
• Apple: Sign In with Apple authentication.

Your use of these third-party features is subject to the respective third-party terms of service and privacy policies. We are not responsible for the content, accuracy, privacy practices, performance, or availability of any third-party services. Links to or integrations with third-party services do not constitute endorsement.

20. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

21. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The App will be uninterrupted, timely, secure, or error-free.
• The results obtained from the App will be accurate or reliable.
• Any content, including User Content, will be available, accurate, or appropriate.
• Outfit search, detection, or music preview features will function correctly at all times.
• The App will be compatible with your device or operating system.

We are not responsible for User Content posted by other users. Any reliance on User Content is at your own risk. We do not endorse, support, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any User Content.

22. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EXHIBIT, ITS OWNER, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF FIFTY U.S. DOLLARS ($50.00) OR THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

23. Indemnification

You agree to indemnify, defend, and hold harmless Exhibit, its owner (Afan Rashid), and any affiliates, agents, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the App.
• Your User Content.
• Your violation of these Terms.
• Your violation of any rights of a third party.
• Your violation of any applicable law, rule, or regulation.

24. Dispute Resolution

Informal Resolution

Before filing any formal legal action, you agree to first contact us at ops@joinexhibit.com and attempt to resolve the dispute informally for at least thirty (30) days. Most disputes can be resolved this way.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law provisions.

Jurisdiction

Any legal action or proceeding arising out of or relating to these Terms or the App shall be brought exclusively in the state or federal courts located in the State of Maryland, and you consent to the personal jurisdiction and venue of such courts.

Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND EXHIBIT AGREE THAT ANY DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS PART OF A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

25. Termination & Account Deletion

Termination by Us

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice, including for violations of these Terms. Upon termination, your right to use the App ceases immediately.

Account Deletion by You

You may delete your account at any time through the App by navigating to Settings > Delete Account. Account deletion is permanent and will result in the removal of:

• Your profile and account information.
• All of your posts, comments, and uploaded photos.
• Your follower and following relationships.
• Your message history.

This action cannot be undone. You may also request account deletion by contacting us at ops@joinexhibit.com.

Survival

The following sections of these Terms shall survive termination: User Content (license grant for content already distributed), Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and General Provisions.

26. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and may notify you through the App or via push notification. Your continued use of the App after any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App and delete your account.

27. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Exhibit regarding your use of the App and supersede all prior agreements and understandings.
• Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by Exhibit.
• Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
• Force Majeure: We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, government actions, internet or infrastructure failures, or third-party service outages.
• No Agency: Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Exhibit.
